The precautionary approach to marine resource use especially concerns itself
with fisheries operations that is conducted in the EEZ but also operations on
the high seas. It is relevant to all marine fish species fishing vessels and
methods of harvesting. It is expected to address the deployment of fishing
vessels and the fishing gear and the proper reporting of catch data.
The marking of fishing vessels, fishing vessel insurance and the obligation
of coastal States and flag States to proper management practices are important
components of the precautionary approach.
The precautionary approach will establish clear principles for fisheries
management and will enforce specific requirements for fishing operations.
The fishing nations are expected to take steps to improve fisheries
management that recognize the principle of sustainable use and should include
conserve approaches to management and development.
The establishment of allowable catch must reflect possible sustainable yield
of that particular resource within a multi-species management framework.
The precautionary approach is expected to reinforce the provisions of
Articles 61, 62 and 119 of UNCLOS III with regards to the responsibilities of
coastal States to:
- the restoration and proper maintenance of ecosystems
- maintenance of biodiversity
- reducing risk of fishing operations on the stocks
- harvesting of fish within the principles of renewability
- reducing by-catch and incidental damage of fishing habitats
- international and regional co-operation for fisheries management
- fisheries monitoring, control and surveillance
- integrated development of small scale fisheries
- trade in fish and fish products as it related to processing of catch on
board fishing vessels and in
- fish processing plants relating to consumer safety.
