Introduction
Considering the events that conducted Argentina to submit a
proposal to amend Appendices I and II of CITES for consideration by the postal
procedure provided for by Article XV, paragraph 2, of the Convention, it was
expected that the CITES Secretariat would recommend its adoption to the Parties
to end a too long history and to enact a decision that was in practice adopted
by the Conference of the Parties at its 11th meeting, CoP11, (Gigiri,
2000).
Surprisingly, it took eight weeks for the Secretariat to
prepare its comments on the proposal and to recommend to the Parties that it be
rejected. The nature of the comments may explain why a long time was needed,
although Article XV, paragraph 2(c), provides that the recommendations of the
Secretariat shall be communicated to the Parties as soon as possible after it
has communicated the proposal (this was done on 12 October 2001 through the
diplomatic channel). It was also a surprise, for which we do not have any
explanation, to notice that the comments and recommendation have been sent
through the diplomatic channel when they used to be sent, including those
concerning the proposals submitted for consideration at CoP11, with a ordinary
Notification to the Parties, e.g. Notification No. 1999/097. It was expected,
however, that copies of the Notifications to contracting or signatory States of
CITES were send direct to the Management
Authorities of all Parties. Nevertheless, it appears from Notification to the
Parties No. 2001/080 of 19 December 2001 that this was not the case.
In view of the above and considering the contents of the
Notification and the comments and recommendation made, IWMC, which obtained
copies of them, felt that comments of its own were necessary, which could be
used by Argentina and/or others to oppose the position of the Secretariat and to
recommend to the Parties that the proposal of Argentina be adopted.
